Medical marijuana insurance issues are the Wild West of workers’ compensation.
The burden of proof is on the employer to establish not only the fact of intoxication, but also the causal connection between that condition and the injury or accident. Since marijuana can stay in a person’s system for 24 hours to 30 days, proving impairment is almost impossible.
So what can employers do? Here are three ways to stay ahead when it comes to medical marijuana.
1.) Get educated about your state’s current marijuana laws, especially the rules on medical marijuana.
2.) Know your work comp laws and what substances are illegal under the legislation. It’s different state to state!
3.) The best practice is to play it safe until work comp legislation should change. Insurance carriers will be slow to change their current stance on medical marijuana. It is advised that employers take a position on the use of marijuana and craft a drug policy that explicitly outlines their position. There are no states that allow employees to use in the workplace or require employers to allow its use on the job.
Marijuana use recreationally and medicinally is on the rise, creating a variety of conflicts for employers and insurers when it comes to pre- and post-employment drug testing for workers and coverage for workers’ compensation claims.

Cell phones are driving many of us to distraction—and taking a toll on productivity in the workplace. Nineteen percent of employers think their workers are productive for less than five hours a day, and more than half believe that cell phones are to blame.
A short call or text message here or there may not harm productivity in a noticeable way, but excessive use can become a big problem.

1. Face reality
Cell phones are here to stay. Although a device-less environment may be your workplace ideal, it is no longer a realistic expectation. Ninety-five percent of Americans now own a cell phone of some kind, and family-friendly employers know that even though work comes first and foremost, personal devices are vital for employees who need to check in with their children and attend to important personal matters during the day.

Most home insurance clients don’t know they could be covered for identity theft, Top Broker Summit attendees heard Monday. “On the personal lines side, there have been a number of companies in Canada that have offered identity theft coverage for 10, 12 or 13 years. I think most Canadians don’t know it’s available,” said Paul Kovacs, founder and executive director of the Institute for Catastrophic Loss Reduction. “Some insurance companies throw it in. Others charge for it. But it’s certainly not a topic that I think the public is aware of. Companies are increasingly worried about the threats lurking in their computer systems. A survey in 2018 by kpmg and Harvey Nash, a firm of headhunters, found that only a fifth of it bosses thought their firm was well prepared for an attack.
